What About that File of Yours?

 

The discovery part of an expert's file is sometimes hotly contested. Must every email be produced? Each text? And if the expert is purely a "consulting expert," what exactly does that mean for the photos she took? According to more than one authority, an unknown consulting expert can become a discoverable fact witness. Do you know how?

Anthony Spaeth

Attorney Anthony Spaeth is a partner at the Houston law firm of Newton, Jones & Spaeth specializing in construction litigation, commercial litigation, and catastrophic personal injury defense. He is a graduate of The University of Texas Plan II Honors Program and The University of Texas School of Law.

 

Representative trials have involved alleged premises liability, personal injury involving allegations of improper motorcycle maintenance, a commercial dispute over heavy equipment repairs, breach of contract and negligence allegations against a general contractor, and  a shareholders derivative action with associated fiduciary and breach of contract claims.
