The Expert Witness Deposition at Trial - A View from the Bench and The Bar 

 

Trial court judges decide whether or not to admit deposition testimony at trial and how the videos and transcripts may be used by the attorneys. Therefore, it's incredibly important to understand their point of view.  In this dinner presentation, our highly respected and distinguished panel of LASC judges and a trial attorney will present on the topic of expert witness depositions and their importance and use at trial. Their discussion will address:
 
  • Pros and cons of video depositions, etc. 
  • Strategic questioning and answering during depositions
  • Use of expert deposition transcripts and videos at trial
  • Do's and Dont's for expert witnesses

Judge Holly J. Fujie 

 

Judge Holly J. Fujie was appointed to the California Superior Court for the County of Los Angeles by Governor Jerry Brown in December 2011, and has been sitting in the Personal Injury Hub of the Stanley Mosk Courthouse since the fall of 2015.  Prior to her appointment, Judge Fujie was a shareholder in the Los Angeles-based law firm of Buchalter Nemer, specializing in complex litigation and she was named by the Daily Journal as one of the Top 100 Most Influential Lawyers in California and one of the Top 50 Women Lawyers in Southern California.   She received her A.B. degree in 1975 from U.C. Berkeley and her J.D. degree in 1978 from U.C. Berkeley’s Boalt Hall School of Law.  In 2008-2009 she was the third woman and the 1st Asian American to serve as President of the State Bar of California.  She currently serves on the California State Bar’s Council on Access & Fairness, on the Judicial Council’s Commission on the Future of California’s Courts and its Joint State-Federal Courts Committee, and as Vice Chair of the California Supreme Court’s Trustee Nominations Committee.  Judge Fujie also serves as Vice Chair of the California Bench Bar Coalition, Vice Chair of the Los Angeles Superior Court’s Community Outreach Committee and as a member of the Board of Governors of the Women Lawyers Association of Los Angeles and of the Advisory Board of the Asian Pacific American Bar Association of Los Angeles. Judge Fujie is a member of the American Law Institute and serves as an Advisor to the Restatement of the Law: Children and the Law.   Judge Fujie is a frequent speaker on a variety of issues relating to the law and the legal profession, and has received many awards for her service to the profession, including the National Asian Pacific American Bar Association’s Trailblazer Award, the Joan Dempsey Klein Distinguished Jurist Award of the California Women Lawyers Association, the Breaking the Glass Ceiling Award of the Leadership Institute for Women of Color Attorneys, the M. Ashley Dickerson Diversity Award of the National Association of Women Lawyers, the Difference Makers Award  of the American Bar Association’s General Practice, Solo & Small Firm Division and  the California Bench-Bar Coalition’s Leadership Award. Since 1992, she has served on, and from 2008-2012 was Chair of, Senator Dianne Feinstein’s Advisory Committee for the Central District of California for federal judicial and U.S. Attorney appointments. 

 

Judge Michelle Williams Court 

 

Judge Michelle Williams Court serves in the Civil division of the Los Angeles Superior Court where she presidesover general jurisdiction civil cases.  Prior to her civil assignment, Judge Court served in the central Family Law division, where she heard a wide variety of custody, visitation, property, domestic violence and other family law matters.  

Judge Court is a member of the Commission on the Future of California’s Court System, Civil Working Group and also serves as a member of the Judicial Council Language Access Implementation Plan Taskforce.  Judge Court is a member of the Executive Committee of the Litigation Section of the Los Angeles County Bar Association, sits on the Board of Trustees of the Los Angeles Law Library and serves on several Los Angeles Superior Court committees, including serving as Co-Chair of the Technology Committee. 

Judge Court is an elected member of the American Law Institute, serves as faculty for the Center for Judiciary Education and Research and has lectured at UCLA School of Law, Loyola Law School and Southwestern School of Law.  While in private practice, Judge Court specialized in civil rights and public interest litigation.  Judge Court is a graduate of Pomona College and Loyola Law School.

 

Esther P. Holm, Esq. 


Esther Holm is a partner in the Orange County office of Lewis Brisbois, co-chair of the Professional Liability Practice,and former vice-chair of the Product Liability Practice. Her specialty is Trial Practice in Professional, General, Employment and Product Liability matters.


In the area of General and Product Liability, Ms. Holm has tried to verdict, cases involving claims of Traumatic Brain Injury, neuropsychological injury, and is a specialist in the use/misuse of PET, SPECT, MRI scans, including Diffusion Tensor Imaging. She has defended and tried to verdict cases involving sexual molestation of a child, bus accidents, paralysis, orthopedic injuries, defamation, wrongful death, wrongful termination of employment and construction defect. She has defended high profile cases of foodborne illness and served as Lead Counsel for the Jack in the Box franchisees sued during the E.coli outbreak in 1993.

Ms. Holm's experience includes defense of hotels and casinos in cases involving claims of assault/battery, and personal injury, with an emphasis on traumatic brain injury.

In the Professional Liability area, Ms. Holm has defended malpractice claims brought against insurance agents and brokers, attorneys, appraisers, home inspectors, homeowner associations and school districts.  She has tried to verdict malpractice claims against real estate agents and brokers.

Ms. Holm has extensive experience defending Common Interest Development and Homeowners Associations, including class actions.

Ms. Holm is a frequent lecturer to the defense industry on the use of PET scans, Traumatic Brain Injury, psychological injuries, evaluation of damages, and real estate law.

Ms. Holm is the creator, director and producer of the firm’s Webinar Series. She serves as Moderator for each of the monthly programs. Ms. Holm is Co-Editor of the Professional Liability Newsletter and a member of the Quality Assurance Committee. She is also a former Judge Pro Tem for the Los Angeles Superior Court and a former Volunteer Mediator.
